Terms of Service

By creating an account or using Legal Tank, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any modification constitutes acceptance of the modified Terms.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old.

Legal Tank is an AI-powered legal document platform that provides:

• AI-assisted generation of legal documents from attorney-vetted templates
• Document customization for all 50 U.S. states and the District of Columbia
• Electronic signature (e-signature) capabilities
• Optional attorney review services via third-party licensed attorneys
• Document storage, management, and export
• Team collaboration features
• Free legal tools and resources

The Service may include both free and paid features. Certain features require a subscription or one-time payment. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

Certain features of the Service require payment. By purchasing a subscription or one-time document, you agree to pay all applicable fees.

• Subscriptions: Subscriptions are billed on a recurring basis (monthly or annually). You authorize us to charge your payment method on each billing cycle until cancelled.
• One-time purchases: Individual document purchases are charged at the time of generation.
• Refunds: Due to the digital nature of our products, refunds are generally not available once a document has been generated. Refund requests are handled on a case-by-case basis at our sole discretion.
• Price changes: We may change pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect for their subscription.

All payments are processed securely through PayPal. Legal Tank does not store your payment card information directly.

Documents generated through Legal Tank are created using AI technology and attorney-vetted templates. You acknowledge and agree that:

• Generated documents are based on general legal templates and the information you provide
• The accuracy of the generated document depends on the accuracy and completeness of the information you supply
• Generated documents may not address all unique circumstances of your specific legal situation
• You are solely responsible for reviewing the final document before use
• We recommend consulting with a licensed attorney before relying on any generated document for significant legal matters

You retain ownership of the content and data you provide to generate documents. You grant Legal Tank a limited license to process your data solely for the purpose of providing the Service.

Legal Tank provides electronic signature functionality. By using our e-signature features, you agree that:

• Electronic signatures created through Legal Tank are intended to comply with the ESIGN Act and UETA
• You consent to conducting transactions electronically
• An electronic signature has the same legal effect as a handwritten signature when all parties consent
• You are responsible for ensuring that all signatories have consented to sign electronically
• We maintain audit trails including IP addresses, timestamps, and user agents for each signature event

Some documents may require notarization or wet ink signatures depending on your jurisdiction. It is your responsibility to determine whether an e-signature is legally sufficient for your specific use case.

Legal Tank offers optional attorney review services. These reviews are performed by independent, licensed attorneys who are not employees of Legal Tank. You acknowledge that:

• Legal Tank facilitates connections between users and independent attorneys
• Attorney reviews constitute a limited engagement between you and the reviewing attorney
• Legal Tank does not guarantee the outcome or sufficiency of any attorney review
• The reviewing attorney's feedback is informational and does not create an ongoing attorney-client relationship with Legal Tank
• Fees for attorney review are non-refundable once the review has been completed

The Service, including all content, features, functionality, software, design, text, graphics, logos, and trademarks, is owned by Legal Tank and protected by intellectual property laws. You may not:

• Copy, modify, distribute, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or alter any proprietary notices or labels
• Use the Service to compete with Legal Tank or create a similar product
• Scrape, mine, or extract data from the Service using automated means

You retain all ownership rights to the personal data, content, and information you provide to the Service. Documents generated through the Service are owned by you upon purchase.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Legal Tank, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising from or related to the Service shall not exceed the total amount you paid to Legal Tank in the twelve (12) months preceding the claim.
• We shall not be liable for any loss, damage, or legal consequence resulting from your reliance on any document generated through the Service.
• We shall not be liable for any delays, interruptions, or errors in the Service, including those caused by force majeure events, system failures, or third-party service outages.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.

You may terminate your account at any time through your account settings or by contacting us. Upon termination:

• Your right to access the Service will cease immediately
• Any active subscription will be cancelled (no partial refunds for unused time)
• Your data will be handled in accordance with our Privacy Policy and applicable data retention laws
• You may request a copy of your data before termination via our data export feature

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could damage or impair the Service for other users.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property disputes.
