When You Need One

When a Cloud on Title Calls for a Court Judgment

A cloud on title is anything in the record, or on the ground, that makes a buyer's title insurer refuse to insure or a lender refuse to lend. Most clouds surface at the worst moment: the escrow officer calls to say the title report shows a problem and the closing is on hold. Some clouds clear with a signature. The rest need a judge, and those are the matters we draft for.

Heirs property with a gap in title is the most common. The record owner died, no probate was opened, and the family has lived in or paid taxes on the house for years. Record title still sits in a dead person's name, divided among heirs, some of whom have died too. Where the heirs agree, an affidavit of heirship and deeds may be enough. Where heirs are missing or will not sign, the quiet title complaint names them, including unknown heirs, and asks the court to settle the shares. If everyone agrees on the shares but not on whether to sell, that is a partition action instead, and we draft that too.

Adverse possession and boundary disputes

A neighbor's fence, driveway, or garage has sat on the land for years, or you have occupied and paid taxes on a parcel titled to someone else. The complaint pleads the specific possession facts and the statutory period.

Forged, void, or wild deeds

A deed signed under a forged signature or a revoked power of attorney, a deed from someone who never held title, or a deed with a defective legal description. The suit asks the court to cancel the instrument.

Tax-sale and tax-deed titles

A buyer at a tax sale holds a tax deed that title insurers will not insure until a court cuts off the former owner and lienholders. Florida has a dedicated statute for this, section 65.081.

Old mortgages, liens, and easements

A paid mortgage never released, a lien from a dissolved company, or an easement that has been abandoned. When the holder cannot be found, the court judgment substitutes for the release they never recorded.

Two related situations route elsewhere. When a living, cooperative party can simply give up the interest, a quitclaim deed is faster than a lawsuit. When the property is held in a trust and the trustee is the one refusing to convey or account, the fix usually starts with a petition to remove the trustee. Pleading and Proof

How to Quiet Title: What the Verified Complaint Must Plead and Prove

Learning how to quiet title starts with the statute, because the complaint is a checklist the court reads line by line. California's version is the most explicit. Under Code of Civil Procedure Section 761.020, the complaint must be verified, meaning the plaintiff signs under penalty of perjury, and must state five things: a description of the property, including both its legal description and its street address; the plaintiff's title and the basis of that title; the adverse claims the plaintiff wants determined; the date as of which title is to be determined; and a prayer for that determination. If the title rests on adverse possession, the complaint must allege the specific facts that constitute it.

Florida asks for a different kind of proof on the face of the pleading. Section 65.061(3) of the Florida Statutes requires the plaintiff to deraign title, tracing it from the original source or for at least seven years before filing, with the book and page of each recorded instrument, unless both sides claim from a common source. Texas trespass to try title petitions follow Rule 783, which requires the premises to be described by metes and bounds or with enough certainty that possession could be delivered from the description alone.

The part owners do not expect is the hearing. In California, a quiet title judgment is never a paper default: Section 764.010 directs that the court shall not enter judgment by default and must require evidence of the plaintiff's title, even when no defendant shows up. Texas requires prima facie proof against a defendant cited by publication under Rule 800. Florida's Section 65.061(4), by contrast, lets the court enter judgment on a default without taking evidence. A judgment only clears the claims of people who were in the case. California Section 762.010 requires the plaintiff to name as defendants the persons having adverse claims, and Section 762.060 adds that the plaintiff must name those whose claims are of record, known to the plaintiff, or reasonably apparent from an inspection of the property. That last clause matters: a tenant, a neighbor using a driveway, or a relative living in the back unit can hold a claim the recorder's office never shows. Section 764.045 confirms the flip side: a claim that was of record or reasonably apparent, but left out, survives the judgment.

For heirs nobody can identify, California lets the plaintiff sue "all persons unknown, claiming any legal or equitable right, title, estate, lien, or interest in the property" under Section 762.060(a). Service on them runs through Section 763.010: on an affidavit showing reasonable diligence to find and serve them, the court orders service by publication. Once it does, Section 763.020 requires the plaintiff to post the summons and complaint on the property within 10 days of the order and to record the lis pendens if it is not already on record. Publication cannot be used against an unknown defendant who is in open and actual possession of the land.

Texas and Florida reach the same place by different rules. Texas Rule 109 lets the clerk issue citation by publication when the plaintiff swears that a defendant's residence is unknown after due diligence, and the court must examine that diligence before granting judgment. Florida Section 49.011(2) expressly permits service by publication in an action to quiet title or remove a cloud. In every state, the diligent search declaration is the paper that decides whether the judgment holds up later, so we draft it around the actual search steps taken: probate and death records, obituaries, voter and property records, and last known addresses.

Recording a Lis Pendens the Day the Quiet Title Case Is Filed

A lis pendens, also called a notice of pendency of action, is a short document recorded in the county land records that tells the world a lawsuit affecting the property is pending. Anyone who buys or lends against the land afterward takes subject to the outcome. Without it, the defendant can sell or mortgage the parcel mid-case and leave you litigating against a new owner who never heard of the suit.

California makes it mandatory in quiet title cases: Section 761.010(b) requires the plaintiff to file the notice with the county recorder immediately upon filing the complaint. The notice must name all parties and describe the property under Section 405.20, a copy must be mailed by registered or certified mail to the adverse parties and record owners before it is recorded under Section 405.22, and under Section 405.21 it can be recorded only if an attorney of record signs it or, for a self-represented party, a judge approves it. Texas Property Code Section 12.007 requires the notice to state the style and number of the case, the court, the parties, the kind of proceeding, and the property, and a copy must be served on each affected party within three days of filing it for record. Florida Section 48.23 lists the parties, the case information, the court, the property, and the relief sought, and the notice expires one year after the action began unless the claim rests on a recorded instrument or the court extends it.

A lis pendens can also be attacked. California Section 405.32 and Texas Property Code Section 12.0071 both require expungement when the claimant cannot show the probable validity of the real property claim by a preponderance of the evidence, and Texas adds failure to serve the notice as a ground. California, Texas, and Florida Quiet Title Rules Side by Side

Each state builds the remedy differently, and a complaint drafted for one will be rejected in another. Texas is the sharpest example: Property Code Section 22.001 makes trespass to try title the method of determining title to land, and Texas courts also recognize a separate equitable suit to quiet title aimed at a specific cloud such as an invalid deed or lien. Choosing the wrong vehicle changes what you must plead and prove. The table below is drawn from the current statutes and rules; for other states we confirm the governing statute before drafting.

Adverse possession claims deserve a closer look because the periods are short and the conditions are strict. California Code of Civil Procedure Section 325 requires five years of continuous occupation and proof, by certified county tax collector records, that the claimant timely paid all taxes levied on the land for those five years. Texas runs from three years under title or color of title (Civil Practice and Remedies Code Section 16.024) to ten years for simple possession (Section 16.026), and Section 16.0265 gives heirs a specific path: a cotenant heir in exclusive possession for ten years who files an affidavit of heirship and an affidavit of adverse possession, publishes notice, and mails the other heirs, can take title if no one contests within five years. Florida requires seven years under either Section 95.16 (recorded color of title) or Section 95.18 (no color of title, with taxes paid and a return filed with the property appraiser).

Two limits apply everywhere. A California quiet title judgment does not bind the state or the United States unless they are individually joined (Section 764.070). And each judgment binds only the parties properly brought in, which is why the defendant list and the service papers get as much drafting attention as the complaint.

How long does a quiet title action take?
A quiet title action runs as long as it takes to find, serve, and answer every person with a claim, so the defendant list drives the timeline more than the complaint does. A suit against one known lienholder who does not respond can move to a proof hearing after the answer period runs. A suit against unknown heirs usually adds a diligent search, a motion for an order of publication, and the publication period itself before the case is ready for judgment. A contested case follows the court's civil schedule through discovery and trial or summary judgment. Can I file a quiet title action without a lawyer?
Yes, in most courts an individual owner can file a quiet title action on their own behalf, and many of our clients do; others hand our draft to their own attorney. Two cautions apply. Some filings have extra requirements for self-represented parties: in California, a notice of pendency of action signed by a party without an attorney cannot be recorded until a judge approves it under Code of Civil Procedure Section 405.21. What is the difference between a quiet title action and a quitclaim deed?
A quitclaim deed is voluntary: the person holding a possible interest signs it and gives that interest up. When that person is alive, reachable, and willing, a quitclaim is usually the fastest way to clear a cloud on title. A quiet title action is the court route for everything else: the claimant refuses, cannot be found, has died leaving unknown heirs, or claims under a forged or void instrument. The judgment binds the parties named and served, including unknown defendants served by publication where the statute allows it, and it is recorded like a deed. Many engagements start by drafting a quitclaim for the cooperative parties and a complaint for the rest.
Does a quiet title action need a lis pendens?
In California it is mandatory: Code of Civil Procedure Section 761.010(b) requires the plaintiff to record a notice of pendency of action in each county where the property lies immediately after filing the complaint. In Texas and Florida a lis pendens is optional but important.
