When Do You Need a Civil Complaint?
You need to initiate a civil lawsuit against a person, business, or government entity and must file a formal written complaint with the court that identifies the parties, states the factual basis for your claims, and specifies the relief you are seeking.
You have a contract dispute, personal injury claim, fraud claim, or other civil cause of action and the statute of limitations is approaching — you must file a complaint to toll the limitations period before the deadline expires.
You have exhausted demand letters and pre-litigation settlement discussions without resolution and are ready to formally commence litigation by filing a complaint and having the defendant served with a summons and complaint.
You are in federal court and must meet the Iqbal/Twombly plausibility standard — your complaint must allege sufficient factual matter, accepted as true, to state a claim to relief that is plausible on its face.
What Should a Civil Complaint Include?
Caption and Jurisdiction
The court name, parties' full legal names, the basis for jurisdiction (federal question under 28 U.S.C. § 1331, diversity under § 1332, or state court jurisdiction), and the venue basis.
Factual Allegations
Numbered paragraphs of factual allegations — who did what, when, where, and why it harmed you. Short plain statements. Exhibit-worthy documents can be attached and incorporated by reference.
Causes of Action
For each legal claim, a separate count identifying the claim (e.g., Count I — Breach of Contract), re-alleging relevant facts, and alleging the specific legal elements with supporting facts.
Damages
Compensatory damages, consequential damages, punitive damages (if the claim supports them), attorney's fees (if authorized by contract or statute), and injunctive or declaratory relief.
Prayer for Relief
A numbered list of every specific remedy requested in the WHEREFORE clause. Include every type of relief you might want — claims not in the prayer may be waived.

Signature Requirements
Check Local Court Rules
Court filings may require wet ink or e-filing system signatures. Check your jurisdiction's e-filing rules before filing.
Many courts now accept e-filed complaints with electronic signatures. Verify your court's e-filing requirements and any verification or certification requirements under local rules.
How to Fill Out a Civil Complaint
Identify the Court and Jurisdictional Basis
Determine whether you are filing in state or federal court. For federal court, identify the jurisdictional basis: federal question or diversity jurisdiction (parties in different states, amount in controversy over $75,000).
Write the Factual Background
Draft a chronological factual narrative in numbered paragraphs. Be specific about dates, dollar amounts, contract terms, and specific acts or omissions. Specific facts support a plausible claim; vague generalities invite a motion to dismiss.
Match Facts to Legal Elements
For each cause of action, research the required elements in your jurisdiction. For breach of contract: (1) existence of a contract, (2) plaintiff's performance, (3) defendant's breach, (4) damages. Map your facts to each element.
Calculate and Plead Damages
Pleading "in excess of $X" or "according to proof at trial" is sufficient in most courts. A specific amount supports a default judgment demand if the defendant fails to answer.
File, Pay the Filing Fee, and Arrange Service
File the complaint, pay the filing fee (typically $350-$500 in federal court), obtain the case number, and arrange service of process within the time allowed — 90 days in federal court under Rule 4(m).
