1.1

1.2

The scope of the Temporary Guardian's authority is limited to the powers expressly set forth in Article III of this Agreement and shall not be construed to confer upon the Temporary Guardian any rights or authority beyond those necessary to provide for the health, safety, education, and welfare of the child(ren) during the period specified herein. This Agreement does not constitute, and shall not be construed as, a transfer of legal custody, termination of parental rights, or adoption proceeding. 1.3

The duration of this Temporary Guardianship shall commence on [____________] ("Effective Date") and shall terminate on [____________] ("Termination Date"), unless earlier terminated pursuant to Article IV of this Agreement. Powers & Limitations
2.1

Medical Authority: Parent(s)/Legal Guardian(s) hereby authorize the Temporary Guardian to: (a) consent to routine medical, dental, vision, and mental health examinations and treatment for the child(ren), including administration of prescribed medications; (b) consent to emergency medical treatment if Parent(s)/Legal Guardian(s) cannot be reached after reasonable attempts; (c) authorize surgery or other invasive procedures only in life-threatening emergencies or with prior written consent of Parent(s)/Legal Guardian(s); and (d) execute HIPAA authorizations and other medical forms necessary to obtain the child(ren)'s medical records and to communicate with healthcare providers. The child(ren)'s health insurance information is as follows: Carrier: [____________]; Policy Number: [____________]; Group Number: [____________].

2.2

Educational Authority: Parent(s)/Legal Guardian(s) authorize the Temporary Guardian to: (a) enroll the child(ren) in school, preschool, or other educational programs and execute all enrollment forms on behalf of Parent(s)/Legal Guardian(s); (b) consent to participation in extracurricular activities, field trips, and school-sponsored events; (c) attend parent-teacher conferences and communicate with school administrators and teachers regarding the child(ren)'s academic progress; (d) consent to special education evaluations and services as recommended by school personnel; and (e) authorize routine school photographs, yearbook participation, and directory listings. The following educational decisions require prior written consent of Parent(s)/Legal Guardian(s): [grade retention, expulsion proceedings, IEP modifications, other: ____________].

2.3

Travel Authority: The Temporary Guardian [is / is not] authorized to travel with the child(ren) outside the State of [_____________]. [If authorized:] Travel is permitted within the following geographic limits: [____________]. International travel requires separate written consent executed by Parent(s)/Legal Guardian(s) and notarized in accordance with applicable law. The Temporary Guardian shall maintain a copy of this Agreement and the child(ren)'s birth certificates and passports (if applicable) at all times during travel. The Temporary Guardian is NOT authorized to: (a) consent to the child(ren)'s adoption or name change; (b) consent to the child(ren)'s marriage or entry into military service; (c) delegate the guardian authority to any third party without written consent of Parent(s)/Legal Guardian(s); or (d) take any action that would permanently affect the child(ren)'s legal status.

Conditions & Revocation
3.1

Triggering Events: This Temporary Guardianship Agreement is entered into in connection with the following circumstances: [Parent(s)/Legal Guardian(s) will be traveling / military deployment of [____________] with orders dated [____________] / medical incapacity of Parent(s)/Legal Guardian(s) / extended absence due to [____________] / other: ____________]. This Agreement shall become effective upon the occurrence of the following event(s): [departure of Parent(s)/Legal Guardian(s) on [____________] / execution of this Agreement / other triggering condition: ____________]. Parent(s)/Legal Guardian(s) shall provide the Temporary Guardian with current contact information, including emergency phone numbers, at all times during the effective period of this Agreement.

3.2

Automatic Termination: This Agreement shall automatically and immediately terminate upon the earliest of the following events: (a) the return of Parent(s)/Legal Guardian(s) and their resumption of direct physical custody of the child(ren); (b) the Termination Date specified in Article I, Section 1.3; (c) the death or incapacity of the Temporary Guardian; (d) the issuance of a court order modifying or terminating this Agreement; (e) the child(ren)'s attainment of the age of majority; or (f) the written revocation of this Agreement by Parent(s)/Legal Guardian(s) as provided in Section 3.3 below. Upon any automatic termination, the Temporary Guardian shall immediately return the child(ren) and all of the child(ren)'s documents to Parent(s)/Legal Guardian(s) or their designated representative.

3.3

Revocation Procedure: Parent(s)/Legal Guardian(s) may revoke this Agreement at any time, with or without cause, by providing written notice of revocation to the Temporary Guardian. Such revocation shall be effective: (a) immediately upon personal delivery of written notice to the Temporary Guardian; (b) upon the Temporary Guardian's actual receipt of notice sent by certified mail, return receipt requested; or (c) at such later time as Parent(s)/Legal Guardian(s) may specify in the revocation notice. Written notice of revocation shall be delivered or mailed to the Temporary Guardian at the address set forth in Article I and shall also be provided to any school, healthcare provider, or other institution that has received a copy of this Agreement. A copy of the revocation notice shall be provided to each institution to which this Agreement was presented.

Acknowledgments & Signatures
4.1

By signing below, each Parent/Legal Guardian acknowledges that: (a) they have read and fully understand this Agreement and the authority being granted to the Temporary Guardian; (b) this designation is made voluntarily and without duress, coercion, or undue influence; (c) they have the legal authority to delegate the powers described herein and that no court order or other legal instrument restricts their ability to do so; (d) they have provided the Temporary Guardian with all information necessary to care for the child(ren), including medical history, insurance information, and emergency contacts; and (e) this Agreement does not affect their parental rights or legal custody of the child(ren).

4.2

By signing below, the Temporary Guardian acknowledges that: (a) they accept the designation and agree to serve as Temporary Guardian of the child(ren) during the period specified in this Agreement; (b) they will exercise the powers granted herein solely for the benefit and welfare of the child(ren); (c) they will not exceed the authority expressly granted in this Agreement; (d) they will promptly notify Parent(s)/Legal Guardian(s) of any emergency, significant event, or matter requiring their attention; (e) they will maintain all documents provided by Parent(s)/Legal Guardian(s) and will return them upon termination of this Agreement; and (f) they understand the obligations and responsibilities of a temporary guardian under the laws of the State of [_____________].

4.3

This Agreement shall be executed in [_____] counterparts, each of which shall constitute an original, and all of which together shall constitute one and the same instrument. This Agreement shall be governed by and construed in accordance with the laws of the State of [_____________]. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Parent(s)/Legal Guardian(s) and Temporary Guardian each acknowledge having had the opportunity to seek independent legal counsel prior to executing this Agreement.
